    1. Who we are and acceptance

    Mono Riders is provided by Giovanne Faccio Tarcitano, a Brazilian sole proprietorship registered under CNPJ 59.366.154/0001-44, based in Curitiba, Paraná, Brazil ("we", "us"). Contact: contato@monoriders.com.br.

    When you create an account, you check a box in the app confirming that you have read and accept these Terms and the Privacy Policy. Using the app without an account is also subject to these Terms.

    2. Minimum age

    You must be at least 16 to create an account. The app asks for your birth year before sign-up and blocks account creation below that age. If we learn that an account belongs to someone under 16, we will delete it.

    If you are 16 or 17, you confirm that your parents or legal guardians know about and agree to your use of the app.

    3. The service

    Mono Riders is a free app that connects over Bluetooth to compatible electric unicycles to:

    • Show real-time telemetry and trigger alarms
    • Record, analyze and share rides
    • Adjust settings that the unicycle itself offers
    • Take part in the community: feed, routes, places, events, segments, rankings and group rides
    • Alert emergency contacts by SMS after a possible fall

    We are not affiliated with any unicycle manufacturer. Begode, Gotway, Kingsong, Veteran, Leaperkim, Nosfet, InMotion and other brands mentioned belong to their owners and appear only to describe compatibility. Features vary by model, firmware and phone.

    4. Risks and safety

    RIDING AN ELECTRIC UNICYCLE CARRIES A RISK OF FALLS AND SERIOUS INJURY. YOU ARE RESPONSIBLE FOR HOW YOU RIDE, FOR WEARING PROTECTIVE GEAR, FOR MAINTAINING YOUR UNICYCLE AND FOR FOLLOWING LOCAL TRAFFIC LAWS. YOU ASSUME THESE RISKS.

    MONO RIDERS IS AN AID. ALARMS, RANGE ESTIMATES, BATTERY AND TEMPERATURE WARNINGS, FALL DETECTION AND EMERGENCY ALERTS DEPEND ON BLUETOOTH, GPS, YOUR PHONE'S BATTERY AND SIGNAL, AND DATA SENT BY THE UNICYCLE. THEY MAY BE DELAYED, INACCURATE OR FAIL. DO NOT RELY ON THEM AS YOUR ONLY PROTECTION.

    • Only ride if you are physically fit to do so, wearing protective gear such as a helmet, and following the manufacturer's manual
    • Change settings while the unicycle is stopped and check the result before riding
    • Avoid interacting with the screen while moving; mount your phone before the ride
    • The available settings are the same ones offered by the firmware and the manufacturers' official apps; you choose which to apply and should follow the manufacturer's guidance

    5. Emergency alert

    When the app detects a possible fall and you do not respond, it may automatically send an SMS with your location to the emergency contacts you added. Today only Brazilian phone numbers are supported.

    Detection may miss a fall or trigger when no fall happened. Sending depends on your phone being with you, with the app open or in the background, battery and signal. Do not use the alert as your main way to get help.

    THE ALERT IS NOT AN EMERGENCY SERVICE AND DOES NOT DISPATCH HELP. SMS DELIVERY IS NOT GUARANTEED. IN AN EMERGENCY, CALL 911 OR THE EMERGENCY NUMBER WHERE YOU ARE.

    By adding a contact, you confirm that this person agrees to receive these alerts and to have their name and phone number stored for this purpose.

    6. Your account and community rules

    You are responsible for your account and for what you post. You may not:

    • Harass, threaten or discriminate against others
    • Post sexual, violent, illegal or misleading content, or content that encourages dangerous riding
    • Post other people's personal data without permission
    • Post third-party content without permission, including photos and logos
    • Spam or send unsolicited advertising
    • Manipulate segment or ranking results
    • Interfere with the service or its security, or access it by automated means without permission

    7. Your content

    You keep ownership of what you post. To run the service, you grant us a free, worldwide, non-exclusive license to host, display, reformat and distribute that content on Mono Riders.

    The license ends when you delete the content or your account, with one exception: segments, public routes, places and events you created remain available to the community after your account is deleted, with no link to you.

    If you send us suggestions or feedback, we may use them to improve the service without payment or credit.

    8. Moderation

    We may remove content, limit posting or suspend accounts that violate these Terms or the law. We use community reports, human review and automated tools, including third-party artificial intelligence.

    We notify you in the app when an action affects your content or account. To request review of a decision, including an automated one, write to contato@monoriders.com.br.

    9. Copyright

    We remove content that infringes third-party copyright when we receive a valid notice, and we terminate the accounts of repeat infringers.

    To report an infringement, write to contato@monoriders.com.br with:

    • Your physical or electronic signature
    • The copyrighted work that was copied
    • The link to or location of the content in the app
    • Your name, address, phone number and email
    • A statement of good faith belief that the use is not authorized by the owner
    • A statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act on the owner's behalf

    You can also report the content in the app using the "Copyright infringement" reason. If your content was removed and you believe it was a mistake, send a counter-notice to the same address.

    10. App intellectual property

    The code, design and Mono Riders brand are ours. We grant you a personal, free, revocable and non-transferable license to use the app under these Terms.

    11. Availability and changes to the service

    We work to keep the app running, but it may be unavailable, change or stop offering features. New models and firmware versions may not be compatible.

    12. Liability

    Nothing in these Terms limits rights that mandatory consumer protection law gives you.

    Within that limit, we are not liable for damage caused by:

    • Defects, failures or limitations of the unicycle, its firmware or accessories
    • Riding style, road conditions, weather or the actions of others
    • Loss of Bluetooth, GPS, signal or phone battery
    • Content posted by other users
    • Use of the app contrary to these Terms or to the manufacturer's guidance

    13. Termination

    You can delete your account at any time in Settings > Privacy > Delete account.

    We may suspend or terminate accounts that violate these Terms, when the law requires it, or to protect other people's safety. When possible, we notify you in advance and explain why. You can appeal at contato@monoriders.com.br.

    14. Changes to these Terms

    When we make a material change, we will publish the new version and notify you in the app at least 15 days in advance. If you keep using Mono Riders after the effective date, you agree to the new version. If you do not agree, you can delete your account before that date. Changes required by law may take effect immediately.

    15. Governing law in Brazil

    For users in Brazil, these Terms are governed by Brazilian law, and disputes may be brought in the courts of your domicile.

    If you have a problem, contact us at contato@monoriders.com.br. Users in Brazil can also file a complaint on Consumidor.gov.br, where we reply within 10 days.

    16. Users in the United States

    If you live in the United States, the following also applies.

    • TO THE EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
    • TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY IS LIMITED TO US$100, AND WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OR LOST PROFITS. THIS LIMIT DOES NOT APPLY TO DEATH, PERSONAL INJURY, FRAUD, GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.
    • You will indemnify us against third-party claims arising from content you post or from your breach of these Terms.
    • Nothing in this section limits rights that cannot be waived under the law of your state.

    17. Other countries

    If you live in another country, the mandatory consumer protection laws of your country still apply, even where these Terms say otherwise.

    18. General

    If any provision is held invalid, the rest remains in effect. For users in Brazil, the Portuguese version prevails; for everyone else, this English version prevails.
